What Legally Qualifies as a Hostile Work Environment
California’s Fair Employment and Housing Act (FEHA) and federal Title VII both require more than a tense or unpleasant workplace. To succeed on a hostile work environment claim, an employee must show that conduct was directed at them because of a protected characteristic such as race, sex, religion, national origin, disability, or age, and that the conduct was severe or pervasive enough that a reasonable person would find it hostile or abusive.
General rudeness, personality conflicts, and management disagreements typically don’t meet that standard. Both the employee’s subjective experience and an objective reasonable-person test must be satisfied. A single egregious incident can qualify, and repeated but less-severe conduct can qualify when it’s pervasive enough to alter the conditions of employment.
Employers sometimes also face a related claim called constructive discharge, which arises when an employee resigns, arguing that workplace conditions became so intolerable they had no reasonable alternative. These claims often accompany hostile work environment allegations.
When Employers Are Held Liable
Under FEHA, liability depends significantly on who engaged in the conduct. Employers can be held strictly liable for harassment by supervisors or managers with authority over the affected employee. For harassment by coworkers, customers, or vendors, liability typically attaches when the employer knew or should have known about the conduct and failed to take prompt corrective action.
California’s FEHA extends broader liability than federal Title VII in several respects, covering smaller employers and a wider range of protected characteristics.
