How California PAGA Claims Work

The Private Attorneys General Act permits an aggrieved employee to seek civil penalties on behalf of the State of California for specified Labor Code violations. Before filing suit, an employee generally must send the employer and the Labor and Workforce Development Agency a notice identifying the alleged violations and supporting facts.

Claims may involve unpaid wages, overtime, meal and rest periods, inaccurate wage statements, expense reimbursement, timekeeping, or worker classification. A representative action doesn’t use the same certification process as a traditional class action, although PAGA and class allegations may arise from the same employment practices.

Cure Opportunities & Penalty Reductions

California reforms affecting notices filed on or after June 19, 2024, expanded the violations that may be cured and introduced potential penalty reductions tied to documented reasonable steps toward compliance. Under the amended Labor Code, qualifying steps taken before a notice may limit the maximum civil penalty to 15 percent of the amount otherwise sought. Qualifying corrective action within the statutory post-notice period may limit it to 30 percent.

These limits aren’t automatic. Eligibility depends on the alleged violation, notice date, timing and adequacy of corrective action, employer size, filing procedure, and other statutory requirements. We apply current law to the specific facts rather than assuming a cure or reduction is available.
