Building a PAGA Defense From Notice Through Litigation

PAGA Cure & Early Evaluation Options

California’s 2024 PAGA reforms expanded certain cure opportunities and introduced additional early-resolution procedures for qualifying employers. A cure is a documented correction of an alleged violation under applicable statutory requirements. It doesn’t automatically resolve every allegation or related wage claim.

The Labor and Workforce Development Agency (LWDA) describes an administrative cure process for qualifying smaller employers and a wage-statement cure process that may apply to employers of any size in qualifying circumstances. After litigation begins, an eligible employer may also seek judicial early evaluation. This court-supervised process may include an early evaluation conference addressing the dispute, proposed corrections, and potential resolution.

Eligibility and deadlines may depend on the notice date, alleged violations, workforce size, available documentation, case posture, and prior use of a cure procedure.
